Tapcheck Electronic and Telephone Disclosure and Consent

This document addresses email and SMS message communications as well as your consent to receive certain disclosures electronically from Tapcheck Inc. and its partners.

Tapcheck Inc. and its affiliates and third party service providers (collectively "Tapcheck") may need to provide you with certain communications, notices, agreements, billing statements, or disclosures in writing ("Communications") regarding services and other products ("Services") Tapcheck provides. Your agreement to this Tapcheck Electronic and Telephone Disclosure and Consent confirms your ability and consent to (i) receive Communications electronically from Tapcheck rather than in paper form, (ii) the use of electronic signatures in our relationship with you, and (iii) your receipt of Short Message Service text message(s) ("SMS") from us ("Consent"). The Services are intended for use only by person(s) who are willing and able to receive Communications from us electronically. If you choose not to agree to this Consent, you may be restricted from using the Services.

Tapcheck provides all Services in accordance with its End User License Agreement, available when you are logged in to the services through either the app or website.

Electronic Delivery of Communications and Use of Electronic Signatures

Under this Consent, Tapcheck may provide all Communications electronically by email, by text message, or by making them accessible via Tapcheck's websites or applications. Communications include, but are not limited to:  (i) agreements and policies required to use the Services (e.g., this Consent, the Tapcheck Privacy Policy, and the Tapcheck End User License Agreement), (ii) payment authorizations, (iii) transaction receipts or confirmations, and (iv) transaction statements. We may also use electronic signatures and obtain them from you.

System Requirements

To access and retain the electronic Communications, you will need the following:

  • A computer or mobile device with Internet or mobile connectivity.
  • An active phone number capable of receiving SMS messages.
  • Access to the email address used to create your Tapcheck account.
  • For desktop website-based Communications:
    • A recent web browser that includes 256-bit encryption;
    • The browser must have cookies enabled. Use of browser extensions may impair full website functionality; and
    • The minimum recommended browser standards which can be found with the most recent versions of Mozilla Firefox (see http://www.mozilla.com for latest version), Apple Safari (see http://www.apple.com/safari for latest version), or Google Chrome (see http://www.google.com/chrome for latest version).
  • For application-based Communications:
    • A recent device operating system that supports text messaging, downloading, and applications from the Apple App Store or Google Play Store; and
    • The most recent versions of Apple Safari or Google Chrome on iOS or Google Chrome for Android OS.
  • Software that permits you to receive, access, and retain Portable Document Format or "PDF" files such as Adobe Reader (available for download at http://www.adobe.com).
  • Sufficient electronic storage space to save Communications on your computer or mobile device's hard drive or other data storage unit and/or a printer to print them.
  • If you use a spam filter that blocks or re-routes emails from senders not listed in your email address book, you must add postmaster@tapcheck.com and noreply@email.tapcheck.com  to your email address book.

You will be notified of any changes to the hardware and/or software requirements that may create a material risk that you may not be able to access or retain Communications. Your continued use of the Services after receiving a notice of such changes constitutes your reaffirmation of this Consent.

Paper Delivery of Communications

You agree that all Communications provided to you in electronic form by us will be considered "in writing." You should print or download for your records a copy of this Consent and any other Communications you wish to retain. We will provide paper copies of any documents that we deliver to you electronically at no cost to you upon request. To submit a request for a paper copy, please write to us at 5850 Granite Parkway, Suite 1000, Plano, TX 75024. We reserve the right to not provide any document that is more than one (1) year old or that we have previously provided to you via paper copy.

Withdrawal of Consent to Electronic Communications

You may withdraw your consent to receive electronic Communications at any time, by writing to us at 5850 Granite Parkway, Suite 1000, Plano, TX 75024.  However, withdrawal of your consent to receive electronic Communications may result in termination of your access to the Services. Any withdrawal of your consent will be effective after a reasonable period of time for processing your request, and Tapcheck will confirm your withdrawal of consent and its effective date in writing (either electronically or in paper form).

Consent to Receive Text Message, Email, and Other Communications

You authorize us to communicate with you via text message, including SMS and third-party messaging platforms, email, mail, telephone calls, and prerecorded telephone calls (each individually, a "Notification" and collectively, "Notifications"). By providing us with your cellular or wireless telephone number, you expressly consent to receiving non-marketing and marketing Notifications at that number — including but not limited to prerecorded or artificial voice message calls, text messages, and calls made by an auto-dialer — from us and our affiliates. This consent applies to all telephone numbers you provide to us now or in the future. Your telephone or mobile service provider may charge you for these calls or messages. Check with your provider for more details. You also agree that we may record or monitor any communications for quality control and training purposes.

At any time, if you wish to stop receiving ("opt-out" of) SMS message or email Notifications, you can do so by contacting Customer Support at support@tapcheck.com or, in the case of SMS messages, replying “STOP” to any SMS message you receive from Tapcheck. Tapcheck may run multiple SMS programs, which may each require a separate opt-out. Upon receipt of your “STOP” message for the applicable SMS program, Tapcheck will send you a single SMS message to confirm that you have been unsubscribed from the applicable SMS program. You agree that we may send you such confirmation even after you've revoked this Consent. At that point, you will no longer receive any further SMS messages from Tapcheck related to the type of SMS program you opt out from (marketing or transactional messages). Tapcheck sends both transactional and marketing messages; you may need to reply "STOP" to both types of messages to completely opt-out. If you wish to opt out of all communications, you must immediately stop using the Services and close your Account, using the instructions provided in this Section. You also acknowledge that for account security purposes we may send you SMS messages, emails or call you regarding your account, even if you have put your number on a Do Not Call list or have opted out of receiving general commercial SMS messages or emails from us. You agree that we shall not be liable for incomplete, lost, late, damaged, illegible, or misdirected Notifications or for any technical problems, malfunctions of any telephone lines, computer systems, servers, providers, hardware/software, lost or unavailable network connections, failed, incomplete, garbled, or delayed transmissions, or damage to any phone or computer system resulting from your participation in or accessing or downloading information in connection with such Notifications.

Updating Your Email Address and or Telephone Number

It is your responsibility to promptly notify us of any change in your email address or telephone number.  You can change your email address or telephone number by writing to us at the address below. You may also be able to change your email address or telephone number yourself through the Services.

Consent

By clicking the “Choose” button next to "I have (a) accessed, reviewed, and consent to the Tapcheck Electronic and Telephone Disclosure and Consent and (b) accessed, reviewed, and agree to the Tapcheck End User License Agreement and acknowledge receipt of the Tapcheck Privacy Policy" which you adopt as your electronic signature, you consent to receive all Communications regarding or relating to the Services. Your further agree that (i) your consent shall last until you revoke it according to the requirements of this Consent, and (ii) your computer or mobile device satisfies the hardware and software requirements specified above.
